Validity
These terms of trade govern the sale and supply of goods by Spares Direct 2 U, to you. Spares Direct 2 U may amend these terms from time to time. You shall be notified of any amendments by a notice on the Spares Direct 2 U web site.
Spares Direct 2 U Contract With You
No contract shall exist between you and Spares Direct 2 U until Spares Direct 2 U has sent you an email confirming receipt and acceptance of your order. Spares Direct 2 U is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods or the order appearing on Spares Direct 2 U site or for unavailability (see 3. below). spares Direct 2 U reserves the right to place restrictions on the volume of any goods ordered. By placing an order for products with age restrictions you declare that you are of legal age to purchase those products.
Pricing and Availability
The prices and availability of the goods are specified on the Spares Direct 2 U site. Such information is subject to change without notice. Each price, as displayed, is inclusive of VAT (at the standard UK rate). There shall be an additional charge for delivery, the amount of which shall vary according to the delivery method that you choose. In the unlikely event that the goods are unavailable, or that Spares Direct 2 U needs to vary the price due to supplier price increases, tax changes or site errors for example, following confirmation of your order Spares Direct 2 U shall send you a notification by email and allow you the opportunity to cancel your order if Spares Direct 2 U has not done so itself.
Delivery of Goods
Spares Direct 2 U shall deliver the goods ordered to the delivery address which you supply. All delivery times quoted on the Spares Direct 2 U site are estimates only based on availability, normal processing and delivery time. Title to the goods will pass to you on payment in full. Risk will pass to you on delivery.
Returns and Refunds
Any items which are faulty may be returned for an immediate replacement or refund. If a part is faulty, we will also reimburse your return postage charges. Goods ordered in error may be returned to us in original unused condition. After 7 days goods ordered in error will be subject to a 50% handling and restocking charge Unless the error is on our part, in which case a full refund or replacement will be given. All returns must be posted at your expense. Refunds will not be given until we have received the goods. In all instances, please contact us by telephone or e-mail to arrange your refund or replacement. Should any goods ordered prove faulty or sub-standard, your carriage charges will be refunded.
EU VAT
Spares Direct 2 U is required to collect VAT at the relevant rate for orders being dispatched outside the UK . If VAT rates in the country of the destination of your order differ from those in the UK , the VAT will be recalculated and included in the product prices shown on the Order Summary page.
Governing Law and Jurisdiction
Contracts between you and Spares Direct 2 U shall be governed by English Law and all disputes shall be submitted to the non-exclusive jurisdiction of the English courts.
Invalidity of Terms and Conditions
If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.
